Registration of inland navigation vessels 

Only inland navigation vessels that are used for purposes of commercial navigation (e.g. carriage of persons, carriage of goods, fishery, dredging, etc.) are eligible for registration on the Belgian register of inland navigation vessels.
This follows from article 271 of the maritime act.
 
Both existing vessels and vessels under construction may be registered.
 
The registration of inland navigation vessels (= in French: bateaux d’intérieur; in Dutch: binnenschepen; in German: Binnenschiffe) is optional.
However, no ship mortgage can be recorded against an inland navigation vessel unless the vessel is registered.
 
Registration is effected at the request of the owner of the vessel.
Foreign owners have to indicate a Belgian address for service.
 
A Dutch or French list of the different documents to be submitted to the ship mortgage registry can be downloaded from this site (see Downloads > Dutch-Nederlands or French-français).

An application for registration of an inland navigation vessel is only granted provided the registration fees and costs have been paid in advance (see FEES).

Deregistration

An inland navigation vessel is deleted from the Belgian register of inland navigation vessels at the request of the owner of the vessel.

The deletion does not affect the entries in the register relating to encumbrances recorded against the ship nor does it prevent these entries from being afterwards cancelled, reduced or renewed.
 
No vessel shall be deleted unless a period of 30 days has expired from the date all registered creditors and all third persons who have had a “beslagexploot/exploit de saisie” ( writ of arrest) registered, have been notified by the registrar.

Technical documents

There exist several technical documents with respect to the inland navigation vessel  and its crew.

Those documents have to be ordered from the services of the department of Mobility and Transport.

ENI-number
 
At the owners' request, a unique European number of identification, or so-called ENI-number, is assigned to inland navigation vessels in the European Union. Each ENI-number consits of 8 digits. The first three digits of any ENI-number assigned by Belgium are: 060 through 069.
In Belgium the General Directorate Maritime Transport grants the application for ENI-numbers (www.mobilit.fgov.be > eau / water > binnenvaart / navigation intérieure).
 
 
 
Teboekstelling van binnenschepen
 
Ingevolge artikel 271 van de zeewet kunnen enkel binnenschepen gebruikt of bestemd voor winstgevende verrichtingen van binnenscheepvaartverrichtingen (vb. vervoer van personen, vervoer van goederen, visvangst, baggerwerken, enz.) worden te boek gesteld in het Belgisch register der binnenschepen.
 
Zowel bestaande als in aanbouw zijnde binnenschepen kunnen worden te boek gesteld.

De teboekstelling van binnenschepen is niet verplicht; zonder teboekstelling kan op een binnenschip evenwel geen hypotheek worden ingeschreven.
 
De teboekstelling gebeurt op aanvraag van de eigenaar.
 
Buitenlandse eigenaars moeten keuze van woonst doen op een adres in België.

De aanvraag van teboekstelling (form.97) kan eveneens worden gedownload vanop deze site (Downloads > Dutch-Nederlands > Formulier 97).
 
Geen teboekstelling van binnenschepen gebeurt dan na voorafgaande betaling van de verschuldigde hypothecaire lonen en kosten (zie Fees).
 
Doorhaling van teboekstelling
 
De teboekstelling wordt doorgehaald op verzoek van de eigenaar van het binnenschip.
 
Ondanks de doorhaling blijven de inschrijvingen betreffende de zakelijke rechten waarmee het schip is bezwaard bestaan en kunnen zij naderhand nog altijd worden doorgehaald, verminderd of hernieuwd.
 
Geen teboekstelling kan worden doorgehaald dan dertig dagen na de datum waarop alle bij de hypotheekbewaring ingeschreven schuldeisers en alle derden, die er een exploot van beslag lieten inschrijven, bij ter post aangetekende brief door de scheepshypotheekbewaarder op de hoogte zijn gebracht.

De aangifte of het verzoek tot doorhaling van de teboekstelling (form. 99) kan eveneens worden gedownload vanop deze site (Downloads > Dutch-Nederlands > Formulier 99).
 
Geen doorhaling van teboekstelling van binnenschepen gebeurt dan na voorafgaande betaling van de verschuldigde hypothecaire lonen en kosten (zie FEES).
 
Getuigschriften
 
Allerhande getuigschriften kunnen op de scheepshypotheekbewaring worden besteld met het aanvraagformulier dat kan worden gedownload vanop deze site (Downloads > Dutch-Nederlands).
 
Technische documenten
 
De verschillende technische documenten die voor het binnenschip en zijn bemanning moeten worden aangevraagd bij de diensten van de FOD Mobiliteit en Vervoer, staan zeer goed beschreven in het Vademecum van de beroepsvaart op de binnenwateren.

ENI-nummer
 
Op vraag van de eigenaars wordt aan de binnenschepen in de EU een uniek scheepsidentificatienummer of ENI-nummer (= european identification number) toegekend. Alle ENI-nummers bestaan uit 8 cijfers, waarvan de eerste drie voor België beginnen met 061 t/m 069.
In België is het Directoraat-generaal Maritiem Vervoer bevoegd voor de toekenning van de ENI-nummers (www.mobilit.fgov.be > water > beroepsvaart-binnenvaart).

Immatriculation des bateaux d’intérieur
 
En vertu de l’article 271 de la loi maritime, seuls les bateaux d'intérieur qui font ou sont destinés à faire des opérations lucratives de navigation.(p.e.: le transport des personnes ou des marchandises, la pêche, le remorquage, le dragage etc.) sont susceptibles d’être immatriculés dans le registre belge des bateaux de navigation intérieure.
 
Tant les bateaux existants que ceux en voie de construction peuvent être immatriculés.
 
L’immatriculation des bateaux d’intérieur n’est pas obligatoire.
Toutefois, aucune hypothèque ne peut être inscrite sur un bateau d’intérieur sans qu’il ait été immatriculé auparavant.
 
L’immatriculation se fait à la demande du propriétaire.
Les propriétaires étrangers doivent élire domicile à une adresse en Belgique.

La demande d’immatriculation (form.97) peut également être téléchargée à partir de ce site (Downloads > French-français > Formulaire 97).
 
Il n’est procédé à aucune immatriculation de bateau d’intérieur qu’après paiement préalable des salaires hypothécaires et frais dus (voyez Fees).
 
Radiation de l’immatriculation
 
L’immatriculation est radiée à la demande du propriétaire du bateau d’intérieur.
 
Toutefois, la radiation laisse subsister les inscriptions relatives aux droits réels qui grèvent le bateau et n'empêche pas la radiation, la réduction ou le renouvellement ultérieur de ces inscriptions.
 
Aucune radiation de l'immatriculation ne peut être effectuée que trente jours après la date où tous les créanciers inscrits à la conservation des hypothèques et tous les tiers qui y ont fait inscrire un exploit de saisie, ont été avisés par le conservateur par voie de notification à faire par lettre recommandée à la poste.

Numéros ENI
 
A la demande des propriétaires, il est attribué un numéro européen unique d'identification ou numéro ENI (= European number of identification) aux bateaux de navigation intérieure. Ce numéro contient 8 chffires, dont les trois premiers sont pour la Belgique: 060 à 069.
En Belgique, le Directorat Général Transport Maritime est chargé de l'attribution des numéros ENI (www.mobilit.fgov.be > eau > navigation professionnelle - navigation intérieure).
